It is an important period for Kenyans to reconsider the education system with the aim of convincing the National Government to provide equitable quality education for all.
The Education Reforms unit is now in motion with a clear-cut command which include the study of all laws leading the basic education sub-sector and making references for review of the laws with a view to addressing ambiguities, duplication and improving linkages.
Premium has to be placed on Article 53(1)(b) of the Constitution. The article states that every kid has a right to free and compulsory basic education.
Article 55(a) which says that the State shall take measures, including affirmative action programmes to ensure that the youth’s access relevant education and training.
To achieve these goals and the specified targets, the unit will have to reconsider and redefine the TSC Act (2012) and the Basic Education Act (2013), and properly make important changes on the laws leading education.
To begin with, Teachers Service commission has to be divided to create a separate body to help as the teacher manager, and a specialised body to serve as the teachers.
General interests of teachers. TSC roles.
The Education Reforms unit should reconsider and assess the Constitution (2010) and the empowering Acts, and make recommendations on the need to analyse the law on education, with the view to making a teacher regulatory body.
The unit should specifically relook at Teachers Service Commission Act which allows the Commission to complete the duties of both the employer and regulator.
The regulator, perhaps to be called Teaching Council of Kenya should be charged with definite functions.
The functions include, developing and reviewing the Code of Conduct and Regulations for Teachers; Registration of teachers; protecting and advancing the general interests of teachers; disciplining errant teachers and regulating professional conduct of teachers and promoting.
It should also enable career progression and professional growth for teachers and more prominently, monitor quality switch and assurance of education facilities and services.
